Does Land Privatization support the Development of Land Market Description:
The new Constitution in 1992 laid the fundamentals for political, social and economic reforms in Mongolia. The transition from communist regime and centrally planned economy to the democratic society and market economy has started in 1989 and is still going on. Land administration is one of the sectors that is most affected by the transition. Land administration has become an entirely new discipline dealing with new concepts, principles, definitions and activities such as land tenure, cadastral surveying and mapping, land registration, land valuation, mortgage etc. Part of the social and economic reform since the beginning of 1990s is the land reform and privatization of land. The main purpose of the land privatization is to provide people with private ownership and consequently benefit from the ownership of land. It was assumed that privately owned land will be used effectively and it will accelerate putting land into economic process. This in turn will contribute to the improvement of livelihood of the people and eventually growth in the economy. Today the following questions are asked: Did land privatization bring the desired results? Is privately owned land put into the economic process? Did the number of sales of land increase? Is private land accepted as collateral by the banks? This paper is more descriptive rather than analytical. The paper will give brief information about the country in order to give an understanding of what the conditions and circumstances are in Mongolia. It will discuss about the land reform and related activities carried out for the development of legislative and institutional framework. Then land privatization will be discussed in detail with some background about privatization of state owned properties in general as there were number of privatization activities. As one of the main objectives of the land reform is the development of well functioning land market, it will provide information about the land market and its development. At the end, the paper will draw conclusions on the land privatization and if it has any impact on the land market. Also, some recommendations for land privatization will be given.
