Cabinet Signs off Kenyas National Land Policy

national-land-policy.jpgIn June 2009, the National Land Policy Formulation Process in Kenya, which began in 2004, witnessed a great stride forward with the Cabinet finally approving the National Land Policy. The National Land Policy offers a platform for fundamental land reforms in the country. The Parliament is expected to discuss and approve the Sessional Paper to be submitted by the Executive Branch soon.

In anticipation of the approval of the Land Policy, the Development Partners Group on Land (DPGL) is working with the Kenya’s Ministry of Lands (MoL) and has agreed on the way forward by adopting the Land Reform Support Programme and Land Information Management System program. These documents will serve as the blueprint on the way forward for reforming the land sector and as a guide for various donors in providing financial support.

For now, the DPGL, currently chaired by UN-HABITAT  is composed of World Bank, Sida, USAID, JICA, DFID, UNDP, FAO & IFAD. DPGL aims to harmonise, align and coordinate support to land reforms in terms of the Paris Declaration. 

In the meantime, discussions are on-going between DPGL and MoL to map out key priority activities for funding in the immediate term. So far, DPGL has committed an amount of about USD13 Million to finance the land sector reform activities. Also, DPGL, through Sida, is supporting the mobilisation of technical experts to work with the Ministry.

On the other hand, UN-HABITAT and Sida have spearheaded discussions on the engagement of Non State Actors (NSAs) in land reforms. These discussions culminated in the formation of a Land Non State Actors Alliance comprising various Non-Government Organisations and Civil Society Organisations (CSOs) as well as a range of private sector organisations. Sida has provided an initial support to implement NSA’s key priorities like engaging with the overall land reform process in the establishment of an effective and vibrant coordinated network of NSAs; contributing to the constitutional review process; and enhancing participation of land dependent communities in the implementation of the Truth Justice and Reconciliation process.
